MARLINTON — A Marlinton property owner is suing a neighbor, alleging tortuous interference with the plaintiff's plan to develop the property.
Oak Hall filed a lawsuit Sept. 15 in Pocahontas Circuit Court against Lesley Williams alleging the neighbor interfered with the plaintiff's plan to develop and market the Marlinton property.
According to the complaint, on March 26, 2003, Hall acquired a 54-acre tract of land and right of way and an additional right of way over separated property real estate in Pocahontas County. As a result of the defendant's actions, the suit says, Hall has suffered damages from being deprived of the enjoyment of using and developing his property.
The plaintiff alleges Williams perpetrated intentional acts of threats and harassment, interfering with Hall's enjoyment and use of his property and demanded a strip of land in exchange for the right of way.
Hall seeks trial by jury, compensatory damages, punitive damages, attorney fees, costs and all other relief. He is representing himself in court.
