New High School Proposed for Pocahontas


Magistrate Candidate May be Living in His Mailbox...

...In order to maintain residence in Pocahontas County.



Candidate Robbie Sharp left Pocahontas for S.C or Georgia and got a postal job down there.  But the desire to be a magistrate was so strong that he decided that he would come back home if the citizens of Pocahontas County wanted him as their magistrate.

But it just doesn't work that way!!!!

You are either a resident of West Virginia or a Resident of some other state.  It's either/or!

But it must be terribly hard for political candidates to figure this out.  We have two people who have moved from Pocahontas County but they would be willing to move back if we give them a job worth $57,000 per year.

There is some speculation that we even may have a judicial candidate who is a resident of Kanawha County nearly three hours away. 

And of course, there is the infamous president of our Board of Education who claims a residence in the Upper End of the County but actually co-habits with his mistress in the Central District.  Emery proudly escorts his concubine around to different events without the presence of his wife.  He is so proud of himself.

Then there was David Fleming who too lived in his mailbox at Greenbank.  When we questioned his residence he had the sheriff raid yours truly's home and seize all his computer equipment and have him taken to jail late at night for simply asking, "Where Fleming lived?

How do grown adults fit into a mailbox?  Wouldn't it be quite uncomfortable ?  Is the kitchen separate from the bedroom.  And wonder where they used the bathroom in that mailbox!  I could never fit into a mailbox!!

Yet, Robbie Sharp wants to be magistrate!

How to Challenge A Candidates Eligibility



§3-2-28. Challenges; notice; cancellation of registration.

(a) The registration of any registered voter may be challenged by the clerk of the county commission, the secretary of state, any registrar of the county, the chairman of any political party committee or by any voter who shall appear in person at the clerk's office. The person challenging the registration shall complete a form prescribed by the secretary of state giving the name and address of the voter and the reason for challenge. The challenge shall be filed as a matter of record in the office of the clerk of the county commission.


(b) Upon the receipt of a challenge, the clerk of the county commission shall mail a notice of challenge to the registrant, setting forth that the voter's registration will be canceled if the voter does not appear in person during business hours at the clerk's office within a period of thirty days from the mailing of the notice and present evidence of his or her eligibility. The form of the notice of challenge shall be prescribed by the secretary of state and shall be mailed by certified mail, return receipt requested.


(c) If the notice of challenge is returned as undeliverable at the registration address, or if the challenged registrant does not appear and present evidence of continued eligibility within the prescribed time, the voter's registration shall be immediately canceled.

Returned mail or failure to appear shall be prima facie evidence of the registrant's ineligibility.

 If the registrant does timely appear and present evidence of his or her eligibility, the clerk shall determine eligibility to be registered as a voter as in any other case. If the reason for ineligibility is that the voter does not reside at the address on the registration and the voter presents evidence of residence elsewhere in the county, the clerk of the county commission shall accept a request for change of address and remove the challenge.

Who Can Vote

WHO CAN VOTE
You are eligible to vote in West Virginia if you are…
  • A resident of West Virginia and the county in which you register.
  • A U.S. Citizen.
  • At least 17 years old, and 18 before the next General Election.
  • Not currently under conviction for a felony, including probation or parole, or a court ruling of mental incompetence. Voting rights are restored when the term of conviction ends.

Public Office was His Worst Nightmare



Jesse Groseclose, candidate for County Commission, said last night that his tenure as a board of education member was his "worst nightmare."  Now he wants to be your next county commissioner!! 

I am not so sure that he will not find it to be any less of a nightmare that his time on the Board of Education. 

This is not really the solution to the problem of regret over public service.  

In fact, if he regrets his service on the Board of Education serving as a representative of the people and the children of Pocahontas County,  he might come to regret his service on the Commission (Of course, $40,000 will probable assuage his regret a little.)

Even worse,  I suspect that he may well become a nightmare for the citizens of the county too.  Some will remember his father re: Denmar and the horrible deal that cost us $250,000.  Some may well remember that his father lost his re-election and Jesse's mother ran for Commission.   

She lost to Mike Mynuk who won with only 43% of the vote.

By then Pocahontas was sick of the name, Groseclose!

Jesse was my nightmare when he made the motion to fire me from 25 years of faithful service for the Pocahontas County Board of Education.  

The reason:  He considered it insubordination for a citizen/employee to question the misappropriation of public funds (code: stealing from the people of Pocahontas County)  Apparently, there is some rule that an employee can not question of theft of public money.

Jesse, took this action also because I questioned Emery Grimes and his concubine.  This leads me to think that he feels that a public whistle blower should keep his mouth shut when he sees the government misappropriate money.  

The County Commission involves millions of dollars.  Are we going to entrust those taxpayer dollars to someone who has this kind of attitude about government service?

Help Jesse avoid another nightmare this May!




The Question Re: a Magistrate Candidate


I checked with the elections division of the Secretary of State re: whether someone who has moved from this state to work full time in another state as a postal employee. 

Here's what they said:

Nothing in the code forbids running for public office by someone who has moved from the county and now lives in another state and is working there.  (Of course, it should be understood that there are laws re: residence in a district.  But the matter has to be addressed.  The County Clerk is responsible for ensuring that people are qualified to vote, and hence if they are qualified to vote.   You might want to call Missy and find out the status of this person as to whether he will be able to vote in this election.  Wouldn't it be ironic if we had a magistrate elected to an office that he himself would not be eligible to vote for himself?  Only in Pocahontas County can crazy things like this happen.  (lol)

But here's the catch:  Someone will have to go to the clerk's office and challenge his/her residency.  The candidate in question would have thirty days to answer the question as to where he/she actual lives.

Residency is a great concern in Pocahontas County.

 Some people remember that current school board president, Emery Grimes, claims to live in the upper end of the county but in reality cohabits with his mistress in the Central District of Marlinton thereby depriving the people of the northern district their due representative.

Emery seems to be proud of the fact that he has both a wife and a mistress.  We are attempting to have him removed from office because his mistress doesn't live in the northern end.

Likewise,  I have a correspondent who has questioned the residency qualifications of someone working in Walt Helmick's office in Charleston and is still claiming to be a resident of Pocahontas County. 

Pocahontas County seems to be a prime target for carpetbaggers.  

Formerly federal government workers were forbidden from running for partisan office but the state changed the situation when they made magistrates and judges nonpartisan.

While I am aware that Heidi Nelson Cruz apparently does suffer from deep depression, just after Hillary Rodham Clinton, she is the next person to be feared the most in this presidential race for 2016. Yes, I believe in common decency, but I also stand for the dignity of women, which means that they must be respected and treated equally even if it requires the truth.
In an article written by Jesse Byrnes for The Hill that was released today on March 25, 2016, under the title "Trump aide fulfills threat to 'spill the beans' on Heidi Cruz," he reports on the recent interview on MSNBC that Steve Kornacki had with Katrina Pierson who is an aide for Donald Trump. See video below.
According to Katrina Pierson, "Spilling the beans is quite simple when it comes to Heidi Cruz. She is a [George W.] Bush operative; she worked for the architect of NAFTA, which has killed millions of jobs in this country; she was a member of the Council on Foreign Relations who—in Sen. Cruz's own words, called - a nest of snakes that seeks to undermine national sovereignty; and she's been working for Goldman Sachs, the same global bank that Ted Cruz left off of his financial disclosure. Heidi's entire career has been spent working against everything Ted Cruz says that he stands for."
According to the Council on Foreign Relations when Heidi Cruz was on the CFR-sponsored Independent Task Force on the Future of North America in 2004, she served at the White House under Dr. Condoleezza Rice as the Economic Director for the Western Hemisphere at the National Security Council as Director of the Latin America Office at the U.S Treasury Department, and as Special Assistant to Ambassador Robert B. Zoellick, then U.S. Trade Representative. Previously, Heidi Cruz had been employed with J.P. Morgan at New York.
Heidi Cruz had contributed to the writing of Building a North American Community, which was published by the Council on Foreign Relations and released in May of 2005. Its goals were the following:
1. ESTABLISH A COMMON SECURITY PERIMETER BY 2010
2. DEVELOP A NORTH AMERICAN BORDER PASS
3. DEVELOP A UNIFIED NORTH AMERICAN ACTION PLAN
4. LAW ENFORCEMENT AND MILITARY COOPERATION
5. SPREAD BENEFITS OF ECONOMIC DEVELOPMENT
6. ESTABLISH A SEAMLESS NORTH AMERICAN MARKET FOR TRADE
7. INCREASE LABOR MOBILITY WITHIN NORTH AMERICA
8. NORTH AMERICAN POLITICAL INSTITUTIONS
All of the aforementioned goals were designed to establish a supranational government that would destroy our nation's sovereignty and supersede our Constitution as the forthcoming North American Union with its own currency call the Amero. The proposed "North American Border Pass" would essentially "erase" our international boundaries with Canada and Mexico. To "Establish a Common Security Perimeter" for North America and "Increase Labor within North America" would weaken our national defense because we would no longer have any authority or control over who enters Canada or Mexico from overseas or elsewhere in the Western Hemisphere.
As a graduate from Claremont McKenna College, the Solvay School of Economics and Management at the Free University of Brussels, and Harvard School of Business, Heidi Nelson Cruz had the opportunity to attend some of the finest private institutions of higher learning in the world. So, as a woman, she has access to effective "analytic tools" for business. But based upon her own record, she has contributed to one of the repressive administrations and also an organization that is attempting to destroy our nation's sovereignty as well as our former standard of living, which has plummeted since NAFTA.

Heidi Cruz the wife of Senator Ted Cruz, is affiliated with an organization that’s trying to build an EU style government right here in North America and take away our sovereignty. So how is it that she’s so actively involved in her husband's campaign when he vehemently opposes her views. Well I’m going to expose some truths about this organization and 
the Cruz’s relationship.

In 2004, Heidi became a member of the Independent Task Force on the Future of North America sponsored by the Council on Foreign Relations. The Task Force advocates a greater economic and social integration between Canada, Mexico, and the United States as a North American region. Or what Lou Dobbs called the North American Union. The council on foreign relations, the CFR promotes globalization, free trade, the reduction of financial regulations on transnational corporations and economic consolidation into regional blocks such as NAFTA and the European Union. That’s right, these are the same guys that promoted NAFTA.

In 2005, the CFR published a document called Building a North American Community. Within the report the task force proposes the creation of a North American community to enhance security, prosperity, and opportunity. The Report recommends the development of a North American border pass and action plan allowing citizens of the three countries to expedite passage through customs, immigration, and airport security within the region. They want to quote “Lay the groundwork for the freer flow of people within North America. They say the three governments should commit themselves to the long-term goal of dramatically diminishing the need for the current intensity of the government's’ physical control of cross-border traffic, travel, and trade within North America. Yeah uh in English this means let’s let all the Mexicans freely cross the border into the United States.

It's very interesting, right? Ted Cruz is on the complete opposite side of his wife's view and her participation in The Council of Foreign Relations. In fact during his run for the senate he was asked about the CFR and he’s quoted as saying they are a pernicious nest of snakes that is working to undermine our sovereignty.

But Heidi Cruz, has relentlessly been campaigning for her husband. And we’re not just talking about event appearances. She’s quoted as saying she’s made over 600 phone calls to potential donors in the first quarter of the campaign alone. No other candidate’s partner has ever stumped for their husband or wife like Heidi Cruz has for Ted. So what is it? What does Heidi Cruz get out of Ted Cruz winning the election, when it goes against her very own political ideologies?

You have to start asking yourself what’s the agenda here. Ted Cruz wants to deport all the migrants but his wife wants an open door policy and free travel between countries. At some point you have to ask is Ted Cruz a secret advocate for the North American Union? How can two people who share the same bed, are diametrically opposed to each other's stance on immigration, be so single mindedly focused on getting into the White House.

You know years ago Bill Clinton let it slip that he and Hillary made a pact that she would support his presidential run which would pave the road for her to run in the future. In fact they even discussed which one of them should run first. This Cruz relationship sounds all too familiar and I’m predicting right now that if Ted Cruz does get into office and lord have mercy on us all if that happens but if it does I believe he’ll switch to support her initiative and we’ll be looking at four years of our sovereignty being dissolved.

Much to the joy of the people but chagrin to the ‘good-ole-boy’ network, 11th Circuit Court Judge James Rowe has resigned and is not going to run again for his current position as judge over Greenbrier & Pocahontas Counties!  During the infamous tenure of former-Judge Rowe, his leniency towards corrupt government officials, towards sex-offenders, and his ludicrous decisions on behalf of the Pocahontas County Solid Waste Authority (PCSWA), as well as his decisions AGAINST LOCAL SENIOR CITIZENS in manufactured cases charged with various allegations upon which there were absolutely NO ADMISSIBLE EVIDENCE – all combined to make Rowe one of the worst judicial officials ever to sit on the bench for any circuit court here in West Virginia!  His ersatz record is only matched by that of ex-Judge Joseph Pomponio, Jr. who also ‘retired’ and left the county within the past year or so!  Both of these two men simply chose to COLLECT COURT COSTS instead of dismissing improper cases and ruling in any type of judicial or honest manner!

THEREFORE WE AS A PEOPLE AND CITIZENS WITHIN THE ELEVENTH CIRCUIT COURT OF WEST VIRGINIA CAN VOTE TO REPLACE BOTH ROWE & POMPONIO THIS ELECTION CYCLE IN THE PRIMARY ELECTION!  THERE IS NO GENERAL ELECTION FOR CIRCUIT COURT JUDGES ANYMORE SINCE ALL JUDGES ARE NOW RUNNING AS NONPARTISAN CANDIDATES – therefore our choice must be positive on Primary Election Day !

THUS LET’S (RE)-ELECT CURRENT JUDGE ROBERT E. RICHARDSON WHO REPLACED POMPONIO – AND LET’S ELECT FRED GIGGENBACH TO REPLACE ROWE!

What makes current Judge Robert E. Richardson stand out is the fact that he has held the deceitful Pocahontas County Solid Waste Authority (PCSWA) to the letter of the law and DISMISSED ALL THE LAWSUITS FILED BY THE PCSWA against the Citizens of Pocahontas County, mostly Senior Citizens to date!  At the current time, the PCSWA has filed civil lawsuits against close to ONE-THIRD, or about 1000 Citizen Households in Pocahontas County, for not paying an arbitrary ‘green-box-fee’ assessed against EACH HOUSEHOLD, whether the landfill is used or not, instead of following the State Law and assessing solid waste fees by WEIGHT, VOLUME & USAGE as defined by State Law whenever solid waste is taken to a landfill!  And while State Law sets forth SIX METHODS of solid waste disposal, only two of which require‘fees’, and FOUR METHODS that EXEMPT a person from any ‘fees’– the PCSWA has ignored all provisions that EXEMPT PERSONS from the proper disposal of solid waste!  These cumulative issues are being brought before Judge Richardson at this time – BUT WHAT JUDGE RICHARDSON HAS ALREADY DONE is DISMISS all the cases brought by the PCSWA when they filed ‘collection cases’ against hundreds of Citizen Households at one time – while only paying for ONE FILING FEE – thereby trying to shift the financial burden upon the backs of the Citizen-Taxpayers for all the court costs!

HERE IS A PROFILE OF CURRENT JUDGE ROBERT E. RICHARDSON:

Robert E. Richardson is a judge for the Eleventh Judicial Circuit, comprised of Greenbrier and Pocahontas counties in West Virginia.[1]He was appointed to the court by Governor Earl Ray Tomblin on May 20, 2014 to fill the vacancy created by the retirement of former JudgeJoseph C. Pomponio, Jr.[2] 
Richardson is running for re-election in 2016.[3] The general electionwill take place on May 10, 2016, the same day as the Primary Election for all other candidates.

Education

Richardson received his undergraduate degree from West Virginia University in 1984, his J.D. from the University of Virginia School of Law in 1987, and his LL.M. in advocacy from Georgetown University in 1989.[4] 

Career

Before his appointment to the Eleventh Judicial Circuit, Richardson was a partner at the law firm of Ford & Richardson in Lewisburg, West Virginia. He also previously practiced law with the Ford Law Firm and was a managing attorney for the West Virginia Legal Services Plan, now known as the Legal Aid of West Virginia.[2]

One of the worst decisions ever made by an alleged‘judge’, who took an ‘Oath’ to uphold the laws, was the one made by former Judge James Rowe in the Pocahontas County Solid Waste cases whereby Rowe claimed that a CITY ORDINANCE in Princeton, WVCity of Princeton v. Stamper, 195 W.Va. 685, 466 S.E.2d 536 (1995), whereby‘every household in the municipal limit’ of the City of Princeton was required to pay a garbage-fee for disposal of solid waste picked up at the curb of their household – WAS SOMEHOW ALSO APPLICABLE TO POCAHONTAS COUNTY – when even a legal student on his first day in law school knows, or should know by then, THAT MUNICIPLAL ORDINANCES ONLY APPLY TO THE MUNICIPALITY INVOLVED AND NO ONE ELSE!

When this same question was recently asked of candidate FRED GIGGENBACH – he was shocked that a sitting judge would make such a ruling and JUDGE CANDIDATE GIGGENBACH stated emphatically that HE WOULD NEVER HAVE MADE SUCH A RULING – AND THAT IF THAT SAME MATTER WAS BROUGHT BEFORE HIS COURT – THAT HE WOULD RULE PROPERLY ACCORDING TO THE LAW!
