‘TIME FOR NEW JUDGES: FRED GIGGENBACH & 
ROBERT E. RICHARDSON’!

Much to the joy of the people but chagrin to the ‘good-ole-boy’ network, 11th Circuit Court Judge James Rowe has resigned and is not going to run again for his current position as judge over Greenbrier & Pocahontas Counties!  During the infamous tenure of former-Judge Rowe, his leniency towards corrupt government officials, towards sex-offenders, and his ludicrous decisions on behalf of the Pocahontas County Solid Waste Authority (PCSWA), as well as his decisions AGAINST LOCAL SENIOR CITIZENS in manufactured cases charged with various allegations upon which there were absolutely NO ADMISSIBLE EVIDENCE – all combined to make Rowe one of the worst judicial officials ever to sit on the bench for any circuit court here in West Virginia!  His ersatz record is only matched by that of ex-Judge Joseph Pomponio, Jr. who also ‘retired’ and left the county within the past year or so!  Both of these two men simply chose to COLLECT COURT COSTS instead of dismissing improper cases and ruling in any type of judicial or honest manner!

THEREFORE WE AS A PEOPLE AND CITIZENS WITHIN THE ELEVENTH CIRCUIT COURT OF WEST VIRGINIA CAN VOTE TO REPLACE BOTH ROWE & POMPONIO THIS ELECTION CYCLE IN THE PRIMARY ELECTION!  THERE IS NO GENERAL ELECTION FOR CIRCUIT COURT JUDGES ANYMORE SINCE ALL JUDGES ARE NOW RUNNING AS NONPARTISAN CANDIDATES – therefore our choice must be positive on Primary Election Day !

THUS LET’S (RE)-ELECT CURRENT JUDGE ROBERT E. RICHARDSON WHO REPLACED POMPONIO – AND LET’S ELECT FRED GIGGENBACH TO REPLACE ROWE!

What makes current Judge Robert E. Richardson stand out is the fact that he has held the deceitful Pocahontas County Solid Waste Authority (PCSWA) to the letter of the law and DISMISSED ALL THE LAWSUITS FILED BY THE PCSWA against the Citizens of Pocahontas County, mostly Senior Citizens to date!  At the current time, the PCSWA has filed civil lawsuits against close to ONE-THIRD, or about 1000 Citizen Households in Pocahontas County, for not paying an arbitrary ‘green-box-fee’ assessed against EACH HOUSEHOLD, whether the landfill is used or not, instead of following the State Law and assessing solid waste fees by WEIGHT, VOLUME & USAGE as defined by State Law whenever solid waste is taken to a landfill!  And while State Law sets forth SIX METHODS of solid waste disposal, only two of which require‘fees’, and FOUR METHODS that EXEMPT a person from any ‘fees’– the PCSWA has ignored all provisions that EXEMPT PERSONS from the proper disposal of solid waste!  These cumulative issues are being brought before Judge Richardson at this time – BUT WHAT JUDGE RICHARDSON HAS ALREADY DONE is DISMISS all the cases brought by the PCSWA when they filed ‘collection cases’ against hundreds of Citizen Households at one time – while only paying for ONE FILING FEE – thereby trying to shift the financial burden upon the backs of the Citizen-Taxpayers for all the court costs!

HERE IS A PROFILE OF CURRENT JUDGE ROBERT E. RICHARDSON:

Robert E. Richardson is a judge for the Eleventh Judicial Circuit, comprised of Greenbrier and Pocahontas counties in West Virginia.[1]He was appointed to the court by Governor Earl Ray Tomblin on May 20, 2014 to fill the vacancy created by the retirement of former JudgeJoseph C. Pomponio, Jr.[2] 
Richardson is running for re-election in 2016.[3] The general electionwill take place on May 10, 2016, the same day as the Primary Election for all other candidates.

Education

Richardson received his undergraduate degree from West Virginia University in 1984, his J.D. from the University of Virginia School of Law in 1987, and his LL.M. in advocacy from Georgetown University in 1989.[4] 

Career

Before his appointment to the Eleventh Judicial Circuit, Richardson was a partner at the law firm of Ford & Richardson in Lewisburg, West Virginia. He also previously practiced law with the Ford Law Firm and was a managing attorney for the West Virginia Legal Services Plan, now known as the Legal Aid of West Virginia.[2]

 Prosecuted highest number of cases statewide in 17 years;
 Has prosecuted child molesters, rapists, murderers, burglars,
     thieves / robbers, financial criminals, animal abusers, drug
     dealers, domestic violence perpetrators & others;
 Cases & convictions upheld by Supreme Court of Appeals of
     West Virginia;
► Will make all court decisions fairly & based upon the Law;
► First to start juvenile delinquent community service work
     program in Greenbrier County;
 Gets drug offenders off drugs via alternative sentencing;
 Experienced in all forms of civil & criminal litigation;
 Successfully prosecuted first case in WV history for felonious
     killing of innocent hunters;
 Made new laws protecting WV Hunters from outside rogue
     hunters;

One of the worst decisions ever made by an alleged‘judge’, who took an ‘Oath’ to uphold the laws, was the one made by former Judge James Rowe in the Pocahontas County Solid Waste cases whereby Rowe claimed that a CITY ORDINANCE in Princeton, WVCity of Princeton v. Stamper, 195 W.Va. 685, 466 S.E.2d 536 (1995), whereby‘every household in the municipal limit’ of the City of Princeton was required to pay a garbage-fee for disposal of solid waste picked up at the curb of their household – WAS SOMEHOW ALSO APPLICABLE TO POCAHONTAS COUNTY – when even a legal student on his first day in law school knows, or should know by then, THAT MUNICIPLAL ORDINANCES ONLY APPLY TO THE MUNICIPALITY INVOLVED AND NO ONE ELSE!

When this same question was recently asked of candidate FRED GIGGENBACH – he was shocked that a sitting judge would make such a ruling and JUDGE CANDIDATE GIGGENBACH stated emphatically that HE WOULD NEVER HAVE MADE SUCH A RULING – AND THAT IF THAT SAME MATTER WAS BROUGHT BEFORE HIS COURT – THAT HE WOULD RULE PROPERLY ACCORDING TO THE LAW!

NOW IS THE TIME FOR ‘WE THE PEOPLE’TO CHOOSE TWO HONEST EDUCATED PERSONS TO BECOME NEW JUDGES FOR THE CIRCUIT COURT FOR POCAHONTAS COUNTY – LET US DO SO BY ELECTING –
