and therein lies the proverbial all seasoning rub- cole was indicted for a felony. however, he was never convicted.
what should be more concerning to the richwood mayor and city council is.....the 'official misconduct' occurred while in uniform and on duty (exceedingly similar to the misdeeds of alkire, wilfong, totten, etc).
the documents clearly state that it was late night, the private security guard allowed them on the property. open, or force open a door of a vehicle at the far end of the property. take what you want as a tag team with one cop on the lookout, then write it up at the scene as an unsolved theft and destruction of property. most likely not the first time they did this, just the first time they got caught. im guessing the only way they got caught was the security guard. he probably recently did rounds and everything was ok. shortly after the cops arrive and leave, the damage and missing stereos are suddenly discovered by the security guard....and possibly a security video camera(s).
it sounds like cole somewhat told the truth. the good mayor states that he is well aware of the 'kentucky issue'. richwood has worked its way into a fine pickle.
if wv were a 'right to work' state they could just terminate cole's employment and be on their merry way in search of a new police chief. since wv is NOT a 'right to work' state, getting rid of cole just wont be that easy.
if they dump him now, he is in the catbird seat to file a nice fat lawsuit against the city.
maybe the voters can take out their rage on the good mayor come election day.
where things get fuzzy with cole is when he refers to the issue as "rumors". the facts of the case appear to be crystal clear.
if I were an attorney in that county, and my client was facing charges of b&e and theft.......why not call the chief of police to the stand as a witness?
the jury would be shaking their heads in disbelief, and the perp would most likely walk free and be found not guilty.
