Unable to Impanel a Jury

Today's trial didn't make it off the ground.

Ferrel wisely asked for a jury.  If he would have been found guilty, he would have owed court costs for all those jurors who were called up.

It seems that they finally got 7 jurors who weren't prejudiced.  Then according to Ferrel the eight juror said that they had a conflict in regards to the "prosecutiion."  Therefor the magistrate dismissed all the charges because of what she heard about the prosecution.

This is the second time a jury has come into rescue Ferrel.  You will remember that he spent  30 months in jail waiting for his first trial.

A local judge ruled that he had a "speedy trial." A jury acquitted him of the charges and he was turned back on the streets which he considers home.

At one point, Ferrel was given "home confinement" by a judge who ruled that he was homeless.

Lesson Learned:  In our county judicial system it is wise to ask for a jury of your peers.  Jurors are the safest way to stand before the court.  They can see through the crap that the courts throw at them.

In Ferrel's case he had a court appointed attorney because he is a pauper.  He has absolutely no income.  He feeds himself out of a dumpster.  All these charges have cost the taxpayers of Pocahontas County almost $60,000.

He was given a traffic ticket for peeing in an alley.  The officer who did that is now serving security for the governor.

Apparently, no one stopped to count the cost of prosecution.

  1. Are you says WV State Police Sgt. Barlow has been assigned to the WV Governors Office as security? Interesting, as he had been reported to WV SP HQ, FBI and the Governors Office (along with Sheriffs Deputies, and other Marlinton Barracks WV Troopers for some "improprieties". Odd on reassigning him, and to with whom. Please give names when reporting public information and all information you have been able to gather. Also WHAT if any remaining charges from the many times the local LEOS have targeted Mr. Kelly are still pending?
WHAT questions did Juror # 8 state or ask about the Prosecutors, that ended up providing "information" about the Prosecutors to the Magistrate who was presiding over these proceedings that led to dismissal of these charges. This is vital information that effects EVERY citizen in this Jurisdiction. Please provide this. This is information about elected and assigned PUBLIC offices paid for with public funds who's job is to be State Investigators, and protect the citizens of this county. Yet we all know many violations of WV code, their duties and responsibilities, and rights of citizens they have violated. Seems this INFO is critical and to ensure this is provided to the other proper authorities and oversights.
