Additional claims of sexual misconduct leveled against Totten in second civil rights suit

MARLINTON – In addition to those leveled by Teressa Schoolcraft, Bradley C. Totten will soon have to answer allegations he used his position as a deputy sheriff to exert undue influence over a woman into sex.
Totten is named as a co-defendant in a four-count civil rights suit filed by Jessica Roberts. In her complaint filed Oct. 5 in Pocahontas Circuit Court, Roberts, 33 and of Dunmore, alleges after a chance encounter two years ago, Totten began a six-month campaign of sexually harassing her.
According to her suit, Totten on an unspecified date in August 2010 responded to a domestic violence call involving Fields and her mother. Afterwards, he drove Fields to a nearby gas station and filled her tank.
A few days later, Fields says she began receiving anonymous messages on Facebook from someone who “promised to help her handle her ongoing support case in family court” and wanted to “hang out.” The person was later revealed as Totten, she says.
In the course of one of their discussions, Fields says Totten touted his “authority to do many things, including planting something on someone.” Fearing what he might do, Fields says she relented when Totten pressured her to have sex with him on Sept. 1, 2010.
The encounter, Fields alleges, happened while Totten “was on duty and in uniform” and in his cruiser. A month later, Fields says they had another sexual encounter his in cruiser with Totten “inform(ing) other officers what he was doing over (his) CB radio.”
According to the suit, Totten secretly filmed one of the encounters. The tape has since been seized by the Federal Bureau of Investigation as part of an “ongoing investigation” of Totten.
The FBI assisted the West Virginia State Police in conducting an investigation into allegations that over the last 20 years Totten either had sex with women who were either under 16 years old at the time or were serving court-ordered sentences through the county Day Report Center while he was working as a deputy. The investigation led to two separate indictments returned against Totten by the Pocahontas County grand jury this year alleging 58 counts of sex-related crimes against eight women, including Schoolcraft.
According the suit, communication between Fields and Totten ceased until March 2011 when she started working for the prosecutor’s office. After beginning her job, Fields says Totten again not only “began pressuring (her) for sexual intercourse,” but also “began harassing her in a sexual nature at the Pocahontas County Courthouse.”
Totten’s advances were “continual and unwelcome” to the point where she quit a month later, she claims.
In her suit, Fields not only accuses Totten of civil rights violations, but also the Commission, which is named as a co-defendant, for enabling a hostile work environment, and constructive discharge. Because the Commission failed to take timely action to “adequately investigate or discipline or terminate” Totten for his actions, Fields alleges she’s suffered, among other things, emotional and mental anguish, humiliation and embarrassment and loss of income.
Fields seeks unspecified damages, interest, court costs and attorneys fees. She is represented by D. Geoff Varney with the Klie Law Offices in Buckhannon.

  1. well my gosh what did chief run a muck say when she told him what was going on with his greatest ,bestess , deputy in the whole wide world ...................let me venture a guess .......he did nothing ........ i wonder if she worked for donna ,and if so was this a way to lay the ground work for the get donna campaign ?????????? you can only lay blame at the feet of runny muck for this entire affair ........... some one could write a graduate thesis on what eight years of the jonese administration is going to end up costing this county ......i bet if you could water board the chief he would admit to knowing exactly what totten was doing all along ..............

    what the voters and citizens need to be asking now......why does the CC and the sheriff have the same attorney?
    of course, this attorney, has now been appointed as a "less than honorable" judge in the crapital city of Charleston in the last few weeks.
    is the CC and juxtaposed jonese gonna get their retainer money back for "representation" of their high priced liar?
    if so, when? THIS IS THE TAXPAYERS CASH. WE ARE PAYING FOR THIS NONSENSE AND THIS IS JUST THE BEGINNING!!!

    now, the CC and chrome dome county cop get to piss away some more fundulation on finding a new high priced liar to represent and attempt to re-write history in the county.

    any other "normal" town (i.e. anywhere but here, or anywhere outside the mountain state) would have the CC screaming for heads to roll, filing lawsuits and proceedings to have "the good sheriff" immediately removed for DERELICTION OF DUTY, FAILURE TO PROTECT AND SERVE, CRIMINAL CONDUCT,
    AND CO-CONSPIRACY COVER UPS.
    OUR CC FILED LEGAL SUIT AGAINST DADDY ALKIRE TO HAVE HIM REMOVED FROM OFFICE AS SHERIFF FOR MUCH LESS.
    WE ARE TALKING ABOUT WOMEN AND CHILDREN BEING RAPED BY THEIR SO CALLED PROTECTORS......UNDER THE COLOR OF LAW!!!
    WHERE IS THE CC ON THIS ISSUE?
    WHERE IS THE "VOICE OF THE PEOPLE"....THE LOCO POCO TIMES EDITORIAL STAFF.....ON THIS ISSUE???

    on the other hand, "the good sheriff" has already conducted his very own "internal investigation" by calling his fellow county cop buddy in the Raleigh county sheriffs department to run a "full investigation" into the PCSD.
    WHERE ARE THE RESULTS OF THIS REPORT?
    IS THERE A REPORT???
    WAS AN INVESTIGATION EVER REALLY CONDUCTED???
    IF NOT, WHY???
    IF SO, DID JUXTAPOSED JONESE PAY FOR IT OUT OF HIS OWN POCKET???
    WERE THE TAXPAYERS SCAMMED AGAIN TO PAY FOR THIS???
    ANYONE IN TOWN EVER SEE ANY COPS FROM RALEIGH COUNTY???? I SURE AS HELL DIDNT!!!

    IF SO, IT SHOULD BE AVAILABLE FOR THE PUBLIC AS THEY PAID FOR IT?
    IF SO, IT SHOULD BE AVAILABLE IF SOMEONE FILES A FOIA REQUEST?
    IS SO, THE FAT MAN........AND OTHERS.......SHOULD BE SCREAMING FOR ACCESS TO IT AT THE NEXT CC MEETING.

    AND IF "THE GOOD SHERIFF" IS BEING SO OPEN AND TRANSPARENT.........WHY DONT HE JUST PROACTIVELY OPEN UP THE DOORS, THE BOOKS, THE INTERNAL DOCUMENTS OF THE PCSD.......AND INVITE THE FBI AND U.S. DEPARTMENT OF JUSTICE IN TO CONDUCT AN INVESTIGATION.
    THIS IS HIS JOB AND RESPONSIBILITY, FOLKS !!!!

    HOW IN HADES IS THE RALEIGH COUNTY PCSD TRAINED TO INVESTIGATE "GOING ONS" IN THE LOCO POCO FOREST???
    HOW IN HADES DOES THE RALEIGH COUNTY PCSD HAVE ADDITIONAL RESOURCES OF PERSONNEL TO SPEND TIME IN THE LOCO POCO FOREST???
    IF THEY EVER DID COME OVER AND CONDUCT AN INVESTIGATION......THE CITIZENS OF RALEIGH COUNTY NEED TO BE SCREAMING FOR A REFUND TO THE TAXPAYERS.......IT AINT THE JOB OR RESPONSIBILITY OF THE RALEIGH COUNTY SHERIFFS DEPARTMENT TO CONDUCT INVESTIGATIONS OUTSIDE OF ITS OWN GEOGRAPHIC JURISDICTION !!!

    THIS ISSUE RAISES A LOT MORE QUESTIONS THAN ANYONE HAS ANSWERS FOR AT THIS POINT !!!

    we can only hope and pray that juxtaposed jonese and the loco poco goon squad is soon subjected to a INVOLUNTARY INVESTIGATION by the FBI and DOJ.......if it aint already in progress with additional criminal charges soon to be announced !!!

  3. Hold on now don't jump the gun our dear Sheriff did a investigation and found no evidence of the best deputy in the state maybe the nation of doing anything wrong.
    He used all of his skills I am sure of it.

    Also I have reports that we have the most honest attorneys in the entire state, the moist respected PA office , that our Sheriffs dept has a spotless reputation of honesty .
    Also there have been several reports of flying pigs in the local area some reaching supersonic speeds with just their wings.

    I hope all the victims of Totten file and take him the Sheriff and the Sheriffs office and the CC to court and break the bank .
    its serves them all right. It was fairly common knowledge what was going on and we can look back and see all the reprisals taken against those who spoke out and or supported
    this blog .
    We all know who the guilty parties are .

  6. All I can say is they all knew what Totten was doing,everyone knew.and anyone that says they didn't is lying,and now we all know it
