Motion Denied



Brad Totten's bid for 20 years of home confinement was denied by Judge James Rowe today in Pocahontas County Circuit Court.  Brad was asking to be allowed to have his sentence reduced from 20 years to 10 years home confinement so that he could work his T-Shirt graphics business from his Hillsboro home.  Judge Rowe said no!

A surprise witness for the prosecution was Holly Sewell who detailed her objection to his motion due to the sexually deviate actions of the former deputy while on the Pocahontas County Sheriff's Police force.  She said that she planned to leave the county in the future.  She testified that Totten had texted her as much as 30 or 40 times a day.

Adding to Rowe's decision was the reading of a portion of a deposition given under oath by Totten related to a civil lawsuit.  In that deposition, Totten was asked if he thought it was appropriate for a deputy to have sex with a kid.  He PLED THE FIFTH!!!  This undoubtedly influence Rowe in his decision.

He remains in jeopardy of ten to 20 years in prison.

Ms. Sewell emphasized that Totten actions reflected negatively on all police officers and that she felt that the Pocahontas County Police Officers were corrupt.

    Everyone was on their best behavior today and wore their Sunday best.
    Special Agent Fred Aldridge of the FBI was there.
    Lieutenant RJ Simon from the WV State Police was there.
    Special Prosecutor Brian Parsons was there.
    Im sure all of them attending in their official capacity sent a clear, cogent, and convincing message to the esteemed court.....and all the other rogue cops in attendance.

    Ironically, Sir Cocky Clifton was no where to be found anywhere near the courthouse, or the confines of town.

    No worries JL, Justice knows where find you.
    Justice is gonna find you.

    Parsons and his prosecutorial company friends are far from finished in the loco poco forest.

    1. you know now that is funny about no j.l. clifton today ,because every time i go to the court house for things like dog tags or early voting i have seen j.l. on all those occasions .........usually right at the front door like one of the greeters at walmart .............but no show on this day of all days .........he should have been there to offer support to an old fellow pervert,and partner in crimes .......... many many crimes............

      Judge Rowe did not have a change of heart because he has always thought that Rotten deserved prison time. I quote from the sentencing transcript that was published in the Commentator in July. ". . . here is an individual who used his position of trust, his position of authority and power over a 17-year old girl to have sex. And that is flat out wrong and that cannot be diminished or minimized. And he has to do his time."

    yeah rowe could have locked him with no bail,no home confinement,$50,000 fine for each of the 67 counts handed down,not accepted the plea deal for just the one count (especially since a grand jury had to spend months on this ),not to mention that he should have gotten life ............back in the day this would have been a death sentence.........but hey they had each others phone # on speed dial ...........if had been anyone else what would the outcome have been ?????????

      in the current day, many still believe it to be appropriate to hang one by the scrotum in the public square.......if they still had a scrotum attached when they arrived in the public square.

  7. was the great chief run a muck in the court room today or was he out on official business like he was when he was supposed to be deposed for the damages part of this case ?????????? when does he answer for looking the other way when all this was going on ,considering how many concerned people told runny muck what was happening with ," the best deputy in the whole wide world ".......... former u.s.m.c. officer should have understood the warning , heads up !!!!!!!!! or was it that he just did not care ????????? he should have his tongue ripped out for the lies he told in the last election ........lets not forget his ads in the times ,remember how people are lying about his deputies ?????? turns out that it was all true ....... he was the cause of it all .....

  8. First I want to thank Holly for standing up in public and speaking out.
    I know this was not easy to do young lady .
    But you did it anyway it shows your more of a adult than any of rottens friends and coworkers and superiors.
    Many need to offer you a BIG thank you for trying to help prevent this from ever happing again.

    Next I want to thank the State Police and the Fbi for showing up.
    To be honest I think the fact that both have kept a diligent eye on this case is the only reason totten went to jail and is still in jail.

    Next I want to thank judge rowe and the special PA who handled this case for demonstrating what they think justice is . your actions have demonstrated to us all
    the type of men you are indeed .

  10. Next I want to thank the victims of Totten who came fowrd and also apologize for the way or Sheriffs office treated you and how the case ended with so many of you having justice ripped away from your finger tips by our judicial system.
    I am so sorry for how you were treated.
    And while I know none of them will ever be man enough to say they are sorry for the treatment and embarrassment you have had to endure I do wish those of you who are strong enough to go after these poor excuses for men all the luck in the world with your cival actions.
    Next I want to thank Norman and company for keeping Totten and related issues in the public's eye and for the resistance to the revenge tactics of the powers that be.
    You are mire a man than they will ever be.
    I have respect for your effort to see justice was done and I have no respect for the cowards who attempted to suppress you.
    I also have no respect for for the media locally and other blogs who failed to offer support for justice when they claim to be on the side of what is morally and ethically right.
    It is clear that is little mire than a lie and in one case a total refusal to say one word.
    I have no respect. For this type of behavior and consider it part of the cover up.
    The actions of true cowards.
    You Norman and company have had the nerve and bravery to do the right thing at great expense o your self from a reputation assassination to injury to loss of property to false.arrest

    if this is all true explain why the judge and pa let him have such a sweet deal and drop so many felony's
    why did he get such a sweet bail deal be real about it justice was not served . Only for one victim perhaps if one of the others had been one of your family your tune would not be the same.

      I understand your frustration, and I don't totally disagree with you. Nothing would make me happier than to see child molesters serve the remainder of their lives in jail, or worse. However, in the real world there are many factors to be considered by the prosecuting attorney. One of the most important factors is the effect on the young women of testifying in open court in front of Rotten, the judge, the jurors and others. This could be as devastating, if not more so, than what Rotten did to them. Although I don't have any personal knowledge of what Brian Parsons did behind the scenes, I am certain that he discussed with the young women the pro's and con's of testifying versus offering a plea to Rotten. While I am just guessing, I would say that if the young women really wanted to go to trial, there would have been a trial. Ten to twenty years is a long time, and there is no guarantee that Rotten will get out in ten. Plus, if he does get out on parole before the end of twenty years, the conditions of parole could still be extremely restrictive. I am also certain that Brian Parsons thought long and hard before offering the plea to Rotten.. Judge Rowe has been down this road many times before, and he understands the positives and negatives of trial v. plea. While I personally would like to have seen a much longer sentence, I can accept without any criticism Brian Parsons' decision to offer Rotten a deal.

    I was searching the wv media outlets last night and noticed the same thing.

    Amazing how real journalists TRAVEL great distance to the loco poco forest to report on the abuse of this animal committing heinous crimes under the color of law.
    On the other hand, to the best of my knowledge....and the last time I checked, neither the loco poco times or wvmr had squat snot to say about the biggest story of the week, if not the month, if not the fall season, in the loco poco forest.

    Instead, we are presented with the burning issues of the day by the loco poco times and wvmr.

    the loco poco times gives us a story on bagpipe dude visiting the elementary school.
    absolutely nothing wrong with this.
    bagpipes are cool. so is music. so are elementary school kids. so is learning.
    however, the children at the elementary school hanging out with bagpipe dude may have been potential victims of sir rotten and the pcsd.
    seems to me the powers that be in the county ought to bring in social workers and psychologists and teach children to not trust the po-po to touch their pee-pee.

    meanwhile, wvmr presents us with another "local" feel good story about a kid baking biscuits.
    "local", in this case, is a kid from 4 hours down the road.....in Charleston.
    nothing wrong with a great story about a kid baking biscuits and kicking butt in the kitchen.
    however, that 10 year old little kid fits the perfect description of "a prepubescent child at risk" of being violated by sir rotten and company.
    what would happen if momma ran out of flour and sent the kid down the street to fetch a bag of flour at the fas-chek???
    if sir rotten were on prowl patrol, he would be salivating and foaming at the mouth at the opportunity to expose the kid to some "community outreach" from his crooked crotch.
    seems to me an in depth story on a serial rapist and sexual offender would be a great public service to every 10 year old kid in the county...and countless others, even those all across the state.

  14. The Sheriffs office has the opportunity to hire a man who will fit the bill if they act fast.
    In Charlestown officer Shawn Williams may soon be looking for a job.
    He seems to have all the qualities our guys are looking for.

    I'm surprised also but I have seen him being guarded by his ex and new wife in the past .
    It appears they were trying to assure he stayed out of others pants.
    How long will she blindly stay at hos side and wait.
    I am sure there are lots of men who want to tell sir rotten they were on home plate so we will see.

      If she ever wants to escape in the short term, she will have the human capital of totten's spawn that she can leverage in family court for housing, cash, and assets.
      However, it may be far more wise and lucrative to wait until Sir Rotten gets kicked from his cage.
      Patiently wait and wait for Rotten to come home. Play the role of the good wife.
      Patiently wait for Rotten's parents to expire and no longer exist on this planet.
      Patiently wait for the ER Totten trust fund and all assets to be duly and legally inherited by Sir Rotten.
      Then, when the millions are ripe for the picking, make her move and file for divorce.
      Instant payoff payola with a golden parachute.
      Half the stash is legally hers for the taking.
      Plunder the family, plunder the kid, plunder and pillage the entire Totten empire village.

  19. Parsons decision sucks plain and simple.
    Drop over 60 counts come on.
    Parson also freely said some wanted wanted to go to court.
    No if I was told thAt o would go after rotten for those victims who wanted to go to court.
    Those women and kids who did not want to testify in court I would accommodate their requests.
    Rotten will still be old enough to do many more crimes when he gets out and I do not see any indication that he would not as he keeps denying and taking the fifth.
    Parsons decision gave Totten a sweet deal just like the sweet deal h got for bail and the great investigation the Sheriffs office did.
    We only know about the 24 women that came forward, I can only wonder how many there really were.
    How much dope was traded he many crimes were overlooked.

  25. what reporting the times did, they did not even question some of the statements ak bull whip told in the times.

    It's been 10 years from the time sir rotten committed his crime he's a different man now and prison is hard on him because he's a ex cop.
    well bless his attorneys little heart and sir rotten.

    He got a super sweet deal and got the other 63 charges dropped which did not happen 10 years ago, if not I doubt he could claim its been 10 years and as for being a different man yes he is he got caught and he regrets the hell out of that.
    and wishes he did not.
    Prison is hard on him awwwwww I wonder if he considered that possibility when he was committing crimes and putting people in jail for committing crimes.

    How do lawyers live with them self after laying it on so thick . And why did the times not challenge those statements .
    He wants to support his family and start a business.
    who in town will put any money in his hand and it was his own house hold member that he committed a crime against that he got convicted ,

    Hopefully now the courts and others professional liars can work over those who enabled all of this and made it possible, then we can hear them tell us how bad it is and how they just made bad choices and have changed m and need this money to support their family when they stood by and did nothing and maybe even covered it up so the best deputy in the state maybe the nation could carry on and protect the community's women with the power bestowed on him.
