The Leyzorek Petition

Editor's Note:  If you read the Pocahontas Times, you only get a small bit of the story.  There are many issues that have not been resolved and it is expected that this issue will proceed to the federal courts.

  2. Did you ever hear of Stella Liebeck? She was the lady who bought coffee at MacDonalds and spilled some on herself. She sued MacDonalds for coffee burns. This, in my opinion, was frivolous litigation. Nevertheless, she got a verdict from the jury of $2,700,000, which was reduced by the judge to $640,000. John's appeal was not frivolous. He is simply saying that people who dispose of their waste in lawful alternate manners provided for by statute should not have to pay the annual "green box" fee. May John be as successful as Stella Liebeck!

    1. although i don`t agree with this law suite ,you are wrong about stella liebeck ........that coffee was so hot that the cup fell apart ,burning her legs and genital area,when it was handed to her through the drive up window ........she needed skin grafts inside and out .......she was an elderly woman who needed long term treatments with large medical bills,as she was left incapacitated .........by the time multi billion dollar a year mcdonalds company paid anything ,stella had passed away ........the pay out did not even cover her medical bills ......yet they sell millions of cups of coffee at two bucks a clip every day...........mcdonalds launched the frivolous law suit whisper campaign to cover up their negligence at drive up windows,and put the word out that you can not sue us no matter what because. hey we are a big company .......as usual mcdonalds told the lie long enough and it became truth,and people bought it hook line and sinker ........ made us feel sorry for the poor ,rich mcdonalds company,they need our help,not the greedy horribly scalded old lady,who winded up in a nursing home............since this time the coffee cups have been made more safe ,changed the lids ,lowered the temp the coffee is stored at,and ask you if you want a drink carrier ......if micky d didn`t do anything wrong ,why did they make the changes??????..no matter how dumb the law suite sounds it is still our only recourse to justice,and is our right as citizens .......besides i can not think of anything else the circuit court judges could be doing .........it is just as stupid as the arrests that are made all the time in this county ,by the sheriffs department ........ most of them are mean and FRIVOLOUS ...........

I am sure after reading John's appeal the court will say OH we did not do what he wanted lets just reverse a 5 to 0 finding and let ever other finding we have made be reversed also, Norman & John the Supreme Court has you number and know full well what they are dealing with, the wheels of justice grind slow, but they grind fine, your game is about over on a lot of fronts.

  4. Did you ever hear of the lunatic asylum at Weston? That is the place you will be if you believe this issue will get anywhere after it has been continuously denied by the Courts. Just like Norman's firing. To quote the WV Supreme Court: "This Courts finds that all other arguments by petitioners are either (1) subsumed in the
    arguments already addressed; (2) irrelevant to whether petitioners owe unpaid “green box” fees;
    and/or (3) otherwise frivolous." (emphasis on the frivolous). As to Norman, I quote the WV Supreme Court again: "Instead, Mr. Alderman turned it into a malicious bashing session over matters that are unrelated to his transfer. This is a case of planned, insubordinate behavior that undermined the Board's authority to provide effective and efficient services to its students. Mr. Alderman's speech is not entitled to First Amendment protection."

  5. Norman can you please tell your readers why nothing about this was on your site until it came out in the Pocahontas times? Why not publish the whole case let the people read what the court said

  6. All females who get arrested and asked to turn informant don't forget to bring rubbers and prepare to swallow, think I'm joking ask around it was this way for years.
    It still may be as its my opinion all have not been brought to justice yet.
    Justice is blind, that sure id the truth around here.
