  3. sounds like our chief run a muck was as big a mistake as we all thought.................i wonder if the county can ever recover from all the damage he has done................................to this date i bet he has still not received any actual police training..................except for buying those four stars on his shirt collar.................reading this answers ,why chris cole was run out of kentucky.................sad to think we gave that horses ass a badge ,and he is allowed to run around and make peoples life miserable.........................can you imagine how much money was wasted on this nonsense..............there is not a war between the people and the sheriff`s office,preserve and protect means us,not them........................imagine how much damage was done by totten............jonese could have nipped that one in the bud...............instead he went on a blood lust vindetta...................to date i do not remember run a muck even saying he was sorry,,,for his gross negligence......................for all of this we now have simmons and martan ,and chief run a muck,instead of some real justice..................reading this transcript sick as it was ,i was left with the thought that whom ever tied the title"" chief run a muck"" to jonese`s ass sure knew what they were talking about........................he sure has run all over the place mucking up every one and reverything he comes in contact with...................i wonder when people are going to get tired of the militarization of our sheriff`s department,,we have lt. cole.......majors and even col.hummel.......so i can see why totten thought he was perfectly in his rights to commit all of those rapes,they think they are at war,against us..................oh yeah what ever happened to the ethics case about using court house security cameras footage in the re-elect run a muck campaign.............all this in a county with less than 8,000 people .................

      19K of which was paid for by the county commission.
      justice has not been served but a whole lot of tums and pepto bismol probably have.

  4. well, this certainly exposes the shenanigans and corruption in pocahontas county by our so called leaders and powers that be.
    both documents are long, but well worth the read.

    its a shame that janet kershner-vanover is gone.
    she was one of the few honest and sincere individuals that did her job without prejudice and helped to expose the corruption of the pcsd, etc.

    i love jonese's comments on "TOTTEN HAD SEX ALL OVER THE COURTHOUSE". this shows he had full knowledge of what was going on. i wonder why his statements to the FBI and media wasnt anywhere close to this statement.
    additionally, jonese sitting in on an interview with one of totten's underage victims and then totally ignoring the victim and totten's crimes- there's "justice" for ya, pocahontas style!!!

    moreover, the citizens of pocahontas now see what jonese and the pcsd thinks of the citizens in the county.
    as jones so eloquently stated, you are either "with us" or "you are evil". nice to know that all the citizens that pay his salary are considered "evil".
    another shining moment is jonese's illegally installed cameras in the courthouses and pomponio turning a blind eye to it under the illusion and guise of "safety".

    hitler and his ss police couldnt be more proud of the leaders of pocahontas.
    selling a "safety" society while stripping individuals of their God given civil and constitutional rights.
    brave new world and 1984 aint got nuthin' on the big brother information society in our county!!!

    1. So weve now got Jonese on the record stating, "Totten had sex all over the courthouse".
      We know from local media accounts and indictments that JL Clifton was also "having sex all over the courthouse".
      Isnt that what courthouses are for- PEOPLE GETTING SCREWED....one way or the other.
      Heck, someone should have submitted an official county seal submission with a HOTEL/MOTEL NEON SIGN hanging on the courthouse.
      It could have easily won based on what actually goes on in our corrupt county.

  5. this reminds me ,what a debt of gratitude,we all owe janet and price,for standing up to jonese,and those two judges..........we should thank them for their personal ,"profile in courage moments they both had in getting rid of totten.........that kind of courage we expect from our elected officials...........imagine if that creep was still on the loose..............i wonder if totten has been spoken for by some fellow inmate,then he can understand first hand what it is like to get raped himself

  6. do you think wiefert was able to explain why he destroyed all those records when he was voted out,when he recently arrived in hell...............after all the people owned those files..............the files were his to turn over,as was the office furniture..................he should have been charged,with destruction of public property.............more than pompanio should resign...................wonder what is behind him cutting and run before his term is up,must be something there joseph ,just don`t smell right ,does it ??????????

    1. I suppose weifort knew about the sanctions and loss of law license that simmons faced when he didn't finish orders when he left the prosecutors office during his earlier tenure.
      What a better way to not leave a paper trail and get busted- take a page from hillary clinton at the rose law firm and SHRED EM BABY!!!!
      no files, no missing orders, no paper trail, no evidence!!!
      what weifort failed to calculate was the files and paperwork already in effect at the courthouse that led directly back to him.

    rowe, pomponio, jonese, etc complain and run donna outta office.........and then they and the citizens of pocahontas county put in office an esteemed local attorney who has a proven track record with the wv bar office of disciplinary counsel of DOING THE EXACT SAME THING....AND ADDITIONAL INFRACTIONS.


    "On November 30, 1990, the petitioner, Eugene Simmons, had his license to practice law suspended for a period of six months. The suspension occurred after two longtime clients of the petitioner filed complaints with the State Bar regarding business transactions they had entered into with the petitioner. In each instance, the client suffered significant financial losses as a result of the petitioner's conduct.
    On October 21, 1991, the petitioner filed a petition for reinstatement of his license. However, he did not file the required Reinstatement Questionnaire until December 1994. During the interim, other disciplinary proceedings were initiated against the petitioner. Consequently, consideration of the reinstatement petition was deferred until the remaining disciplinary proceedings were completed.
    On April 22, 1993, the petitioner was admonished by the Investigative Panel of the Board for accepting a new client after he had received notice that he would be suspended in less than one month. Subsequently, on May 20, 1994, this Court reprimanded the petitioner for violating DR 6-101(A)(3) of the Code of Professional Responsibility by failing to prepare final orders in forty-two criminal cases before leaving the Office of Prosecuting Attorney of Pocahontas County and for further failing to submit several other documents in the same cases. The petitioner was also found to have violated Rule 1.16(d) of the Rules of Professional Conduct because he did not timely return a client file in 1989 after the client terminated his representation. The petitioner was ordered to pass the Multi-State Professional Responsibility Examination and pay the costs incurred in the proceeding prior to his reinstatement to the practice of law.See footnote 3 3
    In further proceedings, the petitioner was again disciplined by this Court for conduct he had engaged in prior to his original six-month suspension. The petitioner was found to have violated Rules 1.2, 1.4(a), 1.4(b), 1.16(a), 1.16(d), and 8.1(b) of the Rules of Professional Conduct for failing to act with reasonable diligence and promptness, failing to return phone calls and otherwise communicate with a client, failing to promptly return a file, and failing to promptly notify clients of his suspension. As a result, the petitioner's license was suspended for an additional month. The petitioner was further ordered to pay the costs of the proceedings against him and as a condition of his reinstatement, to participate in a mentoring program for one year under the supervision of an attorney selected by the petitioner and Disciplinary Counsel."

  8. my favorite part is where sheriff jonese and his jack booted thugs initiated MULTIPLE CRIMINAL INVESTIGATIONS against donna price, as well as janet kershner vanover. one of the investigations even involved galloway and the state police. (recall that donna's husband is/was also a member of the state police). this info comes from straight from the mouth of sheriff jonese in his deposition hearing. ironically, no charges or arrests were ever made.

    donna was right about one thing when she stated to the poco times that "WE ARE LIVING IN A POLICE STATE".

    lets pray the the FBI is investigating these violations of our civil and constitutional rights.

    1. .....and who were the OTHER deputies that janet mentioned? she mentioned deputies, i.e. plural, more than just rotten totten.
      maybe jonese should look inwards with his investigations instead of targeting innocent citizens with his sting operations and setups.

      but, we all know that jonese most likely also deemed those complaints as "not credible" and turned another blind eye on his underlings.

      jonese is also demonstrating how proficient of a law enforcement officer he is. he stated that he just had to "catch" totten having sex.
      yet another failure on his watch.
      leave the real work to the professionals dave--- the fbi and "outside the county" state police.
      moreover, how much respect could "his" deputies possibly have for him when they are usurping his authority and command, and running roughshod across the county.

      .....and why was rotten totten selected by jonese and sent to the fbi national academy as the pearl of the pcsd?

      the documents indicate that rotten totten had at least two (2) sexual escapades on jonese's watch after the good sheriff had full knowledge of the situation.

    Who "paid" for this and where did the funds come from?

    If Jonese is so incompetent to find improprieties in his own department right under his own nose- how in the heck is another sheriff's department supposed to???

  13. He had to catch him hummm if he had listened to those who complained and not assumed they were all liars he would have pressed charges, but wait were all evil if we don't agree with the jack boot gang.
    But what do you expect from a group with nick names like bad check, rotten Totten, run a muck Kentucky fried felon, beer can, two ton, pompous, judge slow, and the key stone auxiliary and honest Eugene .
    Really its surreal to think they are really real people and not fictional people from a bad B movie or cartoon.

    1. Yes they are like B movie villains. And their antics would be comical if they weren't ruining peoples' lives.

      The reason Donna dropped many cases was because those cases were unprosecutable due to the incompetence of the police department. There were either ethical problems with the case (i.e. the parties should never have been accused in the first place), legal problems (illegal search warrants, etc), or just plain old harassment (Cole's treatment of the "terrorist" driver, Totten's antics etc).

      She actually saved the county some money by not incurring unnecessary legal fees, inmate fees and retaliatory lawsuits.

      ditto for diamond dave walton and all the deputies that sat in silence with full knowledge, participation, etc.
      obstruction of justice would be an understatement.
      if the feds start digging a hard rains gonna fall and the levee's gonna break with an litany of federal charges to cleanse our county.

      I wonder just how many times jonese et al tapped on the shoulder of magistrates, judges, etc with ex parte communications and stealthily whispered in their ear, "work with us". how many unjustified convictions and innocent folks sent up the valley to tygart to satiate the wicked lust in their hearts?

    3. look at the bulletpoint where totten was going directly to judge rowe attempting to get illegal search warrants and always stirring up trouble that he "knew something".
      heck, look at all the bulletpoints that involve totten and rowe.........which fully dictate that rowe had absolutely zero business hearing the totten case and should have fully recused himself from the case.
      if rowe had full faith in the justice system he shouldn't have cared one way or the other if he was the sitting judge on the totten case.
      yet, he fought like hell to remain the judge on the case.
      what does that tell you about "justice" in the backwoods of pocahontas???

      P.S. For the record, that "terrorist" that Cole collared...with a speeding ticket.....was actually a female M.D. that lives in WV.
      Cole can now call CNN and let em know he's hot on the trail of the "black widow bombers" of the Winter Olympics!

  14. it sounds like even while totten was being investigated they were railroading defendants ,on his say so.......... and giving depositions ,about what a bad person ,donna price was........all of those convictions should be over turned.............what i would really like to know is,what job is run a muck looking for after he is no longer sheriff????????????.............he seems like he really,really needs to promote an illusion of himself as a major crime buster..............or his he just that inadequate?????????????...

    1. the proceedings state that the proper course of action to remove donna from office was to file a formal complaint with the county commission....yet no one did.....even the judges who are the very ones who are supposed to know the law and procedural framework.
      but you can bet they all knew about it on the county commission.
      especially saffer- he threw his hat in the ring and ran against her....and lost to a girl in the primary race.

    Remember that the news stories about Price were on the FRONT PAGE of the poco times on MULTIPLE OCCASIONS.

    The poco times coverage on a CONVICTED FELON COP ON SEX CRIMES WITH CHILDREN???
    BURIED several pages deep with no front page headline coverage.

    WHY???

    1. Where was the Poco Times on informing the voters of the candidates and their backgrounds?
      A kid working for the high school newspaper could have done a google search and found out that Simmons had lost his law license multiple times and had an extensive history of infractions with the WV Bar.

      Wheres the essential news coverage when we need it?
      Instead we get high profile news stories and photo spreads of pigs doing tricks for assistant prosecutors!!!

  17. And the perfect timing award goes to judge pomponio.....with a whole lotta help from the poco times.
    Pomponio sandbagged donna and threw the entire election with his antics at the courthouse in filing his petition against Price.
    This somehow "leaked" out of the courthouse and straight onto the printing presses of the poco times for front page coverage THE THURSDAY BEFORE THE TUESDAY ELECTION.
    This left absolutely no time for Price to respond in any formidable way that would get her response and her side of the story out.

  19. A very troubling issue is Totten stating that it was his standard operating procedure to NOT inform the prosecutor of a defendants "informant status" until nearing the end of a trial.
    The very tenet and idea of being an informant is critical and should be known UPFRONT to the prosecutor so that the prosecutor has full knowledge of what is going on in a case.
    Moreover, the prosecutor needs to know the informant status in order to cut a plea deal with the defendant in exchange for witness testimony against others.
    If Totten was operating like this, his was shafting his own informants after they had helped him because the prosecutor would have already filed heavier charges against them.

    CHARLESTON, W.Va. -- A Pocahontas County resident filed a petition with the state Supreme Court this week, arguing that the man elected county prosecutor last month shouldn't have been on the ballot.

    McCullough's petition also criticizes Simmons for having been "suspended from the practice of law three times, reprimanded once and admonished twice."

    In 2006, Simmons received his third suspension, for 20 days, for failing to complete estate and financial work for four clients. The Supreme Court required him to work under the supervision of another lawyer for one year.

    Simmons' previous two suspensions were for six months, issued in November 1990, and one month, issued in November 1995, according to a document the state's Lawyer Disciplinary Board filed with the Supreme Court in 2006.

  21. try as they might the serial rapist took a ten to twenty year trip, anyway..........i hope that the victims take this county for every cent ,maybe then this county will wake up.............did you notice that the serial rapist conviction was only #10 for the 10 big news stories for 2013......instead of #1.........fires happen,but serial rapist who just happen to be cops,that shouldn`t happen..................the whole thing was treated like an every day event.............i let my subscription lapse.........what a disservice times and wvmr has done to this poor old county.............

  23. Clifton's attorney filed a complaint about Jonese's video cameras interfering with attorney-client communications.
    Don't worry- Jonese has got everything on tape and will use the tape as he sees fit.
    As Pomponio so eloquently stated, "Jonese is a good man and would never do anything wrong with the tapes. He is only looking after our safety"
    (even if he is BREAKING THE LAW to ensure our "safety".
    Of all people to know that Jonese is breaking the law and violating peoples rights--- Pomponio should be the first to know this.

  24. another instant classic- "jonese was trying to CONTROL the magistrates office and the prosecutors office".....yet he cant even maintain order, control, and decorum over the criminal thugs in his own law enforcement office (i.e. wilfong, cole, totten, etc).

    and the man has the nerve to call out others as incompetent and not knowing how to do their job.

    time for the county commission to file a lawsuit to remove jonese, just like they did with alkire!
