In case you hadn't heard, there was a public hearing at the state capitol in Charleston yesterday concerning Senate Bill SB 347 - Constitutional Carry of firearms. Many law enforcement personnel were there IN UNIFORM speaking out against this bill. Today on facebook, Beth Thaxton posted this note from attorney friend Vaughn Sizemore:

Every uniformed officer from a municipal police department violated W.Va. Code §8-14-19(a)(2) today, which states, “A member of a paid police department may not . . . Use any official authority or influence, including, but not limited to, the wearing by a municipal police officer of his or her uniform for the purpose of interfering with or affecting . . . the passage or defeat of any ballot issue.”
The consequences for their political activity should be, under W.Va. Code §8-14-19(d), “Any member of any such paid police department violating the provisions of this section shall have his appointment vacated and he shall be removed, in accordance with the pertinent provisions of this section.”
Under W.Va. Code § 8-14-19(e), if three residents of the city file a written complaint with the police civil service commission, the officer must answer and defend his actions in a public hearing. If the hearing shows the officer was present, in uniform at the Capitol, then the commission is directed to declare the appointment of said member vacated and immediately remove said member from the police force and from the payroll of said city.
Similarly, for deputies, W.Va. Code §7-14-15(a)(2) states:
“A deputy sheriff covered by the provisions of this article may not . . . Use any official authority or influence, including, but not limited to, the wearing by a deputy sheriff of his or her uniform, for the purpose of interfering with or affecting . . . the passage or defeat of any ballot issue.”
Under W.Va. Code §7-14-15(d), “Any deputy sheriff violating the provisions of this section shall have his appointment vacated and he shall be removed.” The process for removal is the same as for municipal officers, with the three residents filing a complaint, the hearing, followed by the removal from office.
I don’t want to see officers and deputies removed from office, but I don’t want to see them violating the law either. Their presence, in uniform, violated WV law and they are subject to removal from office for their illegal actions. Any officer who was paid to be there was also lobbying, without registering as a lobbyist---another violation of law.
