It's Been Done (and by Democrats)

Read it and weep, Democrats. The shoe is on the other foot. David Bernstein at the Washington Post’s Volokh Conspiracy blog:
 Thanks to a VC commenter, I discovered that in August 1960, the Democrat-controlled Senate passed a resolution, S.RES. 334, “Expressing the sense of the Senate that the president should not make recess appointments to the Supreme Court, except to prevent or end a breakdown in the administration of the Court’s business.”  Each of President Eisenhower’s SCOTUS appointments had initially been a recess appointment who was later confirmed by the Senate, and the Democrats were apparently concerned that Ike would try to fill any last-minute vacancy that might arise with a recess appointment.
The GOP opposed this, of course. Hypocrisy goes two ways. But the majority won.

    There is little to read and nothing to weep. Such a resolution by the Senate is not law and therefore is not binding on the Executive branch of our government.

  2. Terrible comparison; the resolution was to prevent a "pocket appointment," which was an appointment to the Court while the Senate is on recess. Today's events are nowhere near that situation; the Senate will be back in session for a long time prior to the president's end of term, so Obama will have no opportunity for a pocket appointment. Republicans are stalling and threatening to vote anyone down simply out of hate for Obama. Ever hear how the Republicans cry about Obama not following the constitution? Typical hypocrites for them to now suggest a Supreme Court appointment should be delayed for a year.

    1. You and your ilk are still dead wrong on your interpretation of SR334. If you love your nation and believe in its values, then you must believe in the Constitution which confers appointment power upon the President subject to the Senate's consent, which is exactly the procedure President Obama is following (he is not making a recess appointment as you and your ilk fear).

    2. First of all, the Republican Senate is not obstructionist because of their hate for Obama - it is because they do not want to relinquish their control over the Supreme Court to Democrats. Second of all, Road Runner does not know what American values are, because Americans twice elected Obama over losers such as McCain and Romney.

      Why do you refer to "values"? Are you a follower of Mr. "Potatoe" Head, Dan Quayle? The Supreme Court is all about enforcing the law, not forcing the values of some people on everyone else.

  4. No doubt Obama will want to put a baby killing tax people till they bleed and let every illegal alien get benfits type in such a position.
