BY STATUTE, AUTHORITIES ARE REQUIRED BY LAW TO REPORT ANY ABUSE OF A MINOR..............OR ANYONE ELSE. THIS STATUTE WOULD COVER THE JUDGE, THE GUARDIAN AD LITEM, AND THE CHILD AND YOUTH ADVOCACY CENTER. this document brings up new questions. DID THE ABOVE INDIVIDUALS AND AGENCIES REPORT ROTTEN'S ACTIVITIES TO THE PCSD? DID THE ABOVE INDIVIDUALS AND AGENCIES REPORT ROTTEN'S ACTIVITIES TO THE STATE POLICE, THE FBI, AND THE U.S. ATTORNEYS OFFICE? it is highly unlikely that rotten was reported to anyone outside the local community. and if he was reported, then it means "heap big trouble" for the pcsd. if he wasn't reported, it means "heap big trouble" for the above individuals..........yet, even when they reported it and brought it to the attention of the powers that be.........it fell on deaf and dumbass ears........and NOTHING WAS DONE to investigate Rotten.
it is easy to see why counsel and the victims see a problem with rowe, etc. it came to their attention AS EARLY AS 2008.....................AND NOTHING WAS DONE BY THE COURT, ETC UNTIL 2012 AND 2013. THATS FOUR TO FIVE YEARS AFTER BEING NOTIFIED !!! its no wonder why people shake their heads in disbelief at the strange happenings in the loco poco forest.
The one positive out of this letter..............is that the wv supreme court is starting to learn just how F'D UP the loco poco forest is. If nobody aint aware of the problem............aint nuthin' gonna be done about the problem. unfortunately, these pencil pushers push so many papers around, u have to wonder if they ever really pay attention to the levity of the content on said pages.
Rowe states that he has "no interest in the outcome of these cases"............... ............yet somehow found himself able to perform his job relating to a criminal case regarding Rotten. ............and somehow found the ability to perform his job relating to a criminal case regarding Alkire. ............and somehow found the ability to perform his job relating to a criminal case regarding Wilfong. ............and somehow finds the ability to perform his job relating to civil cases regarding Rotten.
............and somehow cant find the ability to perform his job relating to a case regarding Price.
At least Pomponio found the judicial wisdom to recuse himself from the Cocky Clifton Case. ............and very soon, Rowe is going to have the opportunity to decide if he has the ability to perform his job relating to a criminal case regarding Sir J.L. Clifton, Esquire.
The difference is that Judge Rowe interacts with Donna Price and other lawyers on a primary level, and with the officers on a secondary level. That is why Judge Rowe recused himself automatically in Donna's case but not Totten's. For the same reason Gene Simmons recused himself automatically in Donna's case. Judge Rowe did the right thing here in letting Chief Justice Davis decide whether or not recusal was proper.
don't get me wrong. ive said the same thing before- rowe was proper to recuse himself. with rowe being one of the complaintants against price with the wv bar odc, it was a no brainer.
what is troubling is no recusals with the corrupt cops. I get the lawyers and lawyers thing......but in the justice system, all of the participants are essentially 'officers of the court'- even law enforcement officers. each day, rowe would have had at least one deputy in his courtroom to introduce the judge, ensure security, haul people off to jail, etc. over time, however formal or casual, relationships develop between judges and officers in their courtrooms.
rotten was a deputy for over 14 years, and interacted extensively with rowe on a 'regular and routine' basis. rowe testified in price's wv bar odc hearings that rotten would approach him in chambers, etc.....and seek rowe to sign search warrants- without the presence of anyone from the prosecutors office. rowe should have put an end to that the first time it ever happened. rotten would have had a comfortable relationship with rowe to ever even approach him in that manner.
anytime you have a county with only one or two judges, they are going to have a relationship with every cop in the county. to play it safe, all the circuit court judges should recuse themselves when these situations arise.
Nothing to fear its Honest Rowe And them you got honest Clifton , Honest Beer Can Bob. Honest Simmons, Honest Totten, Honest Jonese, Honest Cole And Honest Diamond Dave.
They have all proven to me at one time or another just what kind of person they are . Why worry I know just how it will all go.
