Totten is the Tip of the Iceberg

Word is that the heat is just starting to go up.  Watch carefully over the next 12 months.  There are more "important" people on deck and ready to go down.  Judge Rowe made a quiet statement that he hoped the rest of the law enforcement got their "just dues."  AND THEY WILL!!! Hang in there!  There are at least four other people who are being investigated.

Law enforcement and the legal profession are in trouble in Pocahontas County.

Expect to see some more  cell mates for Totten, yet!!  THIS IS ONE SICK COUNTY!!!

We are talking about underage girls--more than one!

Judge Rowe himself said that our criminal justice system is in jeopardy in this county.  See the Totten letter and pay particular attention to the blacked out section. 

 Totten offered to shed a great deal of light on that particular part of our county.  There are those that believe that the blacked out section refers to the Pocahontas County Sheriff's department.  

I have it on good authority that a much broader investigation is going on and is still very much alive.

We heard Judge Rowe read a statement today which named another officer as a person of interest to the police. He went on to say that the length of time that this has gone on is "breath taking."  These things didn't start overnight and they will not end overnight.

Suggested Punishment By Designing T-Shirt's

Former Pocahontas County  Deputy Sheriff, Brad Totten asked for alternative sentencing so that he could design T-Shirts for a living.  He was willing to never interact with Pocahontas People again if he could be put on home confinement.  In lieu of that his lawyer suggest that he be referred by the court to further diagnostic evaluations for 60 days.  Judge Rowe would nothing to do with that.

Deceased former Prosecutor had tried to assist Totten with a sympathetic letter written in Totten's favor requesting that Totten not be put under the jail.

Totten issued a heart-felt apology for his behavior.  He said that having spent 4 days in the Regional Jail he never wanted anything to do with going back.  He said that he had rededicated his life to God and his family.

Rowe described Totten as ambitious, energetic, and wanting to do the right thing.  Rowe displayed a great level of disgust over the sexual behavior of Totten and hinted that other law enforcement should get their due to.

Rowe read a victim statement and a statement from Totten.  He allowed two of the girls to testify but they were not present.  Totten's lawyer tried to prevent them from testifying.  The victim admitted to being underage and too young to have a driver's license.  According to her Totten was very aggressive in his sexual escapes.  He even tried to get her to meet him the Marlinton Municipal building for sex.

Another girl implicated a D McMillion in her story.    This girl said that she was going to meet, "David"  When one girl asked Totten if he had a condom (which he didn't) she said "you are stuck with oral sex.

Both girls said they didn't have to worry about getting in trouble at the Prom because they had a deputy in their pocket.

Rowe spoke about the cynicism that has arisen in our county because of the exploits of law enforcement.  He said that it will take years to heal this county.  According to Rowe even pre-pubescent  females were not safe in this county.

When the issue of Totten's safe in the pen was raised, the judge was not sure how good the jails are at keeping person's like Totten safe.

According to Totten's lawyer, he hasn't left home for over a year except for contact with the courts or his legal defense.

Several years ago I worked with land surveyors. We used a theodolite to determine the legal boundaries of land and for the placement of legal markers, such as an iron pin at property corners. After the survey, all angles were recorded on the plats relative to magnetic north. Previous land survey plats were always the basis of the new survey. These records are kept at the courthouse in the county wherein the land lies.

We often found that the older documents did not match our new measurements. We usually attributed this to a technology gap, today's instruments being more accurate and using lasers etc. as opposed to chains and angle measurers. We also attributed differences in measurements to the previous surveyor's expertise.

An interesting study would consist of comparing older property plats with the most recent ones. If magnetic north measurements are consistently skewed in a certain direction, this could give valuable insight. the data for this investigation is already in the courthouse deed and records rooms across the nation.

Variation in the magnetic field has been taken into consideration for centuries, and it has been recognized that there's a shift in this variation. USCGS publishes tables on this with periodic revisions, and the variation for a given location can be determined by shooting a bearing on Polaris and comparing it to a compass bearing.
Ideally, a survey using magnetic bearings would include the contemporary variation, permitting current variation to be factored in. Less precise (and not allowing for local anomaly) it is possible to look up the historic regional variation for the date on the survey - or, more convenient on location, a bearing can be shot on existing landmarks and the compass bearings can be compared to those on the original survey to derive a conversion factor.
When a current survey does not agree with a previous survey it would trigger an investigation into the source of the error. Not to do so would invite certain legal complications.
